Terms of Service
These terms cover your use of Specfold: the website at getspecfold.com and the app at specfold.app (together, the "Service"). By creating an account or using the Service, you agree to them on behalf of yourself and the company you use it for. "We" and "us" means Specfold.
1. The Service
Specfold is software for home builders and remodelers. You upload a job's files, and Specfold organizes the selections, vendors, lead times, subcontractor scope and client decisions in them, and produces documents from them. We improve the Service over time, which can mean adding, changing or removing features.
2. Accounts
- The Service is for businesses. You must be at least 18 and able to agree to these terms for your company.
- Give accurate information and keep it current. Sign-in uses one-time codes sent to your email, so keep that inbox secure; you're responsible for activity in your account.
- Owners decide who joins their company in Specfold and what they can do. You're responsible for the people you invite.
- Each company gets one free plan, verified with a mobile number. Creating extra companies or accounts to get more free jobs isn't allowed.
3. Your content
Your files and the information in them (plans, quotes, photos, videos, messages, and details about your clients, vendors and subcontractors) are your content, and you keep all rights to it. You give us permission to store, copy, process and display your content only as needed to run the Service for you, including sending it to the service providers listed in our Privacy Policy (for example, to read files with AI models).
You confirm that you have the right to upload your content and to share your clients', vendors' and subcontractors' information with us for this purpose.
4. AI results
Specfold uses AI models to read your files and draft schedules, scope and messages. Results can be incomplete or wrong, so each item shows the file it came from. Review results before you rely on them or send them to anyone. Specfold doesn't provide architectural, engineering, legal or financial advice, and decisions about your projects remain yours.
5. Acceptable use
Don't use the Service to break the law or anyone's rights; upload malware; try to access other companies' data or our systems without permission; overload or disrupt the Service; or resell it without our written agreement.
6. Plans and billing
- Free plan. One active job, for as long as you like. A job is active from its first upload until you mark it complete; completed jobs stay read-only at no charge.
- Paid plans. Starter and Pro are priced per active job after the free one, monthly or yearly, at the prices on our pricing page when you subscribe. Prices are in US dollars and don't include taxes, which we'll add where the law requires.
- When you're charged. Plans are billed in advance for each period and renew automatically until cancelled. Adding a job charges the prorated amount for the rest of the current period right away; marking a job complete credits the unused time to your next bill.
- Payments are processed by Stripe. You authorize us to charge your payment method for these amounts.
- Failed payments. If a payment fails, we'll email the owner and retry. If it still can't be collected, your paid plan ends and the company moves to the free plan, as in section 7.
- Price changes. We'll give you at least 30 days' notice by email before a price change takes effect for your plan.
- Discounts such as the founding-builder offer apply for the period stated when you received them.
7. Cancelling and refunds
Owners can cancel anytime in Settings, under Billing. The plan stays active until the end of the period you've paid for. Then the company returns to the free plan: you choose one job to keep, and your other active jobs are archived for 30 days, during which you can export or reactivate them. After 30 days, archived jobs and their files are permanently deleted.
Payments aren't refunded for partly used periods. If you were charged by mistake, email help@getspecfold.com within 30 days and we'll refund the charge.
8. Suspension and termination
You can stop using the Service and ask us to delete your company's data at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if you don't pay, or if we need to protect the Service or other customers. Where we reasonably can, we'll tell you first and give you a chance to export your content.
9. Other services
The Service relies on other companies, such as Stripe for payments. Their own terms apply to your use of their services.
10. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free.
11. Limitation of liability
To the extent the law allows, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
12. Indemnity
You'll defend and indemnify us against claims arising from your content or your breach of these terms.
13. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Florida.
14. Changes to these terms
We may update these terms. If a change is material, we'll email account owners at least 30 days before it takes effect. Continuing to use the Service after that means you accept the updated terms.
